Terms of Service

1. Acceptance of Terms
By accessing or using Yobitel Technologies' services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.
2. Service Description
Yobitel provides GPU cloud infrastructure, bare-metal GPU servers, managed Kubernetes, and related services (collectively, the 'Services'). Service specifications, availability, and pricing are described on our website and in applicable order forms.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use. You must be at least 18 years old to create an account.
4. Acceptable Use
You agree not to use the Services for any unlawful purpose, to distribute malware, to mine cryptocurrency without explicit authorization, to attempt to gain unauthorized access to other systems, or to violate any applicable export control laws.
5. Payment Terms
Fees are billed in advance on a monthly or annual basis as specified in your order form. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' written notice.
6. Service Level Agreement
Yobitel commits to 99.95% uptime for managed services as detailed in our SLA. Service credits are available for qualifying downtime events. The SLA does not cover scheduled maintenance windows communicated with 48 hours' advance notice.
7. Intellectual Property
You retain all rights to your data and applications. Yobitel retains all rights to the platform, APIs, documentation, and proprietary technology. Neither party acquires any rights to the other's intellectual property except as expressly stated herein.
8. Limitation of Liability
To the maximum extent permitted by law, Yobitel's total liability shall not exceed the fees paid by you in the twelve months preceding the claim. Yobitel shall not be liable for indirect, incidental, special, or consequential damages.
9. Termination
Either party may terminate this agreement with 30 days' written notice. Yobitel may suspend services immediately for non-payment or violation of the Acceptable Use Policy. Upon termination, you may export your data within 30 days.
10. Governing Law
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law provisions. Any disputes shall be resolved through binding arbitration in Wilmington, Delaware.
